1. Acceptance of Terms
Welcome to Stayqa. By accessing and using our platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use our services.
2. Description of Service
Stayqa is a digital platform that provides:
- Property management tools for owners and managers
- Bed space booking and reservation services
- Payment processing and rent collection
- Tenant management and communication tools
- Maintenance request tracking
- Financial reporting and analytics
3. User Accounts and Registration
To use our services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.
4. Property Manager Responsibilities
Property managers who list accommodations on Stayqa agree to:
- Provide accurate and complete property information
- Maintain accurate availability and pricing
- Ensure properties meet safety and habitability standards
- Respond to booking requests in a timely manner
- Honor confirmed bookings and reservations
- Process refunds according to our cancellation policy
- Comply with all applicable laws and regulations
5. Tenant Responsibilities
Tenants who use Stayqa to find accommodation agree to:
- Provide accurate personal and payment information
- Respect property rules and regulations
- Pay rent and other charges on time
- Maintain the property in good condition
- Not sublet or transfer occupancy without permission
- Report maintenance issues promptly
6. Booking and Reservations
Booking Confirmation: A booking is confirmed only after payment has been processed and you receive a confirmation notification.
Check-in/Check-out: Guests must check in at the specified time and check out by the agreed time. Late check-out may incur additional charges.
Occupancy: Only the number of guests specified in the booking may occupy the property. Additional guests may be charged extra.
7. Cancellation Policy
Our cancellation policy allows for full refunds when cancelled:
- Flexible: Full refund if cancelled 24+ hours before check-in
- Moderate: Full refund if cancelled 3+ days before check-in
- Strict: 50% refund if cancelled 1+ week before check-in
Refunds are processed within 5-7 business days to the original payment method.
8. Payments and Fees
Stayqa facilitates payments between property managers and tenants. By using our payment services, you agree to:
- Pay all amounts due in full and on time
- Authorize us to process payments automatically for recurring rent
- Pay any applicable convenience fees or processing charges
- Accept that property managers set their own pricing and policies
Failed payments may result in late fees, service suspension, or booking cancellation at our discretion.
9. Prohibited Activities
You may not use our platform to:
- Post false, misleading, or fraudulent listings
- Engage in illegal activities or violate any laws
- Harass, abuse, or harm other users
- Copy, modify, or distribute our platform content
- Attempt to gain unauthorized access to our systems
- Use our platform for any unauthorized commercial purposes
- Interfere with the proper operation of the platform
10. Intellectual Property
The Stayqa platform, including all content, features, and functionality, is owned by us and is protected by Indian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.
11. Limitation of Liability
Stayqa provides a platform for connecting property managers and tenants. We are not:
- A party to any transaction between users
- Responsible for the accuracy of listings or user information
- Liable for any disputes between property managers and tenants
- Guaranteed to verify the identity or background of users
To the maximum extent permitted by law, Stayqa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our platform.
12. Indemnification
You agree to indemnify, defend, and hold harmless Stayqa and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of our platform or any violation of these Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts with competent jurisdiction in India.
14. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our platform and updating the "Last updated" date. Your continued use of Stayqa after such changes constitutes your acceptance of the new Terms.
15. Termination
We may terminate or suspend your account and access to our platform at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our platform will immediately cease.
